State Inspector's Service: The decision to publish materials related to Mikheil Saakashvili will be made if the rights and safety of the participants in the process are not endangered

State Inspector's Service has released a statement regarding the letter of Mikheil Saakashvili, where the former President calls on Londa Toloraia to publish video footage and interim findings on the investigation.

As InterPressNews was informed by the State Inspector's Service, despite the fact that there is a high public interest in the mentioned criminal case (which is respected by the Service), the investigative body is guided by the law in the first place.

According to them, the decision to make the materials related to Mikheil Saakashvili public will be made only if the rights and safety of the participants in the process are not endangered and if it will not hinder the investigation.

"According to the criminal procedure legislation, the circle of persons authorized to access criminal case materials is strictly defined. Especially in a criminal case for which the investigation has not been completed and a final decision has not been made.

Therefore, the publication of criminal case materials (including video recordings) and information about the progress of the investigation requires special care. Especially in the conditions when the Service has not received the conclusions of important expertise, including the conclusions confirming the authenticity of the video footage.

At the same time, the lawyers of the third President of Georgia Mikheil Saakashvili (who are provided with complete information about the investigation and have the opportunity to communicate and submit opinions without delay) know that only their consent and / or desire can not be the basis for disclosure of case materials. The decision to disclose the materials will be made only if the rights and safety of the participants in the process are not endangered and if it will not hinder the investigation.

The Service will remain in active coordination with the lawyers and will continue to provide them with information about the investigation," the agency said.
